Terms and conditions

1. General

When you become a registered user with North West Personal Assistance (NWPA) (“Registered User” means either a person paying a subscription to NWPA or non-subscribing person using the services described in these terms and conditions), you agree to abide by these terms and conditions. These terms and conditions may be varied by NWPA from time to time and it is your responsibility as a registered user to keep up to date with the terms and conditions. No other terms and conditions shall apply or have any effect on the applicability of these terms and conditions which shall govern to the exclusion of all other terms and conditions.
The information contained in this web site does not represent any statement by NWPA as to the suitability or otherwise of the Employer or Personal Assistant (PA). Nor does NWPA accept any responsibility or liability whatsoever for the quality, suitability or timeliness of the PA’s work. It is entirely your responsibility as the Employer to ensure that the PA, their terms and conditions of employment or the outcome of their work are appropriate and meet your requirements.

2. Scope of service

NWPA provides an on-line easy access web based advertising and recruitment tool linking registered users and enabling them to interactively manage their own advertising, recruitment or employment. This is only applicable to Individual Employers looking to directly employ a PA or a PA looking to be employed directly.  To achieve this, NWPA posts the information provided by registered users and provides them with a search and contact facility. Each registered user understands and agrees that NWPA has no involvement concerning matching or recommending registered users to other registered users as well as understanding that NWPA has no obligation to provide registered users with suitable links and cannot and does not give any guarantee as to suitability of links. A link shall be considered an interaction between PA registered users and Employer registered users, and this shall be satisfied by NWPA providing the facility for one party to communicate with the other party.

3. Subscribing (Registered Users)

As a subscribing registered user, you may receive the services described at  www.nw-pa.org/howitworks from NWPA.
For Employers please see our payment options for a description of the current rates to become a registered user of NWPA.  For PAs registration to this site is free of charge.
NWPA may change the subscription fees at any time, which for existing registered users will take effect on expiry of their then current period of subscription, but otherwise will be with immediate effective. NWPA will endeavour to give registered users 30 days notice of any change in subscription fees before implementing any change.

4. Registration

NWPA may immediately terminate your registration without warning if you breach any of these terms and conditions (as may be amended from time to time), if NWPA receives any complaint about your conduct, or if you act in a manner deemed inappropriate by NWPA. You may terminate your membership at any time, for any reason, effective upon receipt by us, by emailing a notice of termination to [email protected]. However, you acknowledge and agree that you will not be entitled to any refund of any membership fees paid to NWPA.  No refunds will be issued to those that sign-up to the “Preview Available PAs” option.

5. Our responsibilities

We will respect your information and will comply with all applicable data protection legislation in force in England and Wales. At times we may be required to disclose your personal information to contracted third party suppliers where this is necessary to fulfil our obligations to you. Such third party suppliers shall only be entitled to use your personal information to fulfil its obligations to NWPA. By becoming a registered user of NWPA you are consenting to NWPA using your personal information to provide the services and provide you with information about products and/or services offered by NWPA which may be of interest to you. If you do not wish your details to be disclosed to contracted third party suppliers, then please email [email protected] stating this request in writing. In order to maintain the integrity of this website, we reserve the right to forward your contact details to any regulatory authorities when requested to do so, including the police.

6. Your responsibilities

You are responsible for any information that you give which must be specific and relate to your current needs. As an employer you agree that you are solely responsible for ensuring the suitability of candidates for the vacancy you are advertising, or the job you are applying for.
For Employers it is recommended that you undertake a thorough face to face interview, take steps to verify previous employment and qualifications, take up character and work references, undertake a DBS check and other actions you consider necessary to confirm the integrity of a candidate.  You also agree that age, gender or ethnicity data or any other such information provided by an applicant will not be used in any employment-related decisions you make. However, this is your responsibility and NWPA accepts no responsibility or liability for the placing of a candidate.  Due to the potential legal implications NWPA strongly recommend that you seek advice and guidance from your local support service which may be found via our ‘contact us’ page.

7. Registered Users profiles

All contents of registered user profiles are subject to our approval. We reserve the right in our sole discretion to reject or remove any registered user profile at any time if we believe in good faith it fails to conform to applicable laws and regulations, our policies or the public interest. In addition, we may reject any URL link or personal contact details embodied within any advertisement.
NWPA will endeavour to send regular reminders to registered users with regards to the subscription renewal and/or vacancy status for Employers, and application details and/or availability status for PAs. NWPA reserve the right to deactivate the accounts of registered users who have not used the service for a period of one month or more (as calculated by the date of last connection to the service).

8. Access to site services

While NWPA will endeavour to ensure the availability of this website, we do not guarantee that it will be uninterrupted or error free.
In addition, access to this website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

9. Commercial use by Registered Users

Registered users may not use the services offered through this website or the website itself for illegal and/or unauthorised usage, including collecting usernames and/or email addresses of registered users, by electronic or other means for the purpose of sending unsolicited email and unauthorised framing of or linking to the website. Any such action will be investigated, and appropriate legal action may be taken, including without limitation, civil, criminal, and injunctive remedies.

10. Security

You are responsible for ensuring that you keep your user name and password confidential.  In the event you have forgotten your password, a link will appear at time of attempt to log-in offering you the chance to renew.  Please note, NWPA have no record of passwords.

11. Use of site

NWPA authorises you to view and download the materials at this web site only for your personal, non-commercial use, provided that you retain all copyright and other proprietary notices contained in the original materials on any copies of the materials. You may not modify the materials at this site in any way or reproduce or publicly display, perform, or distribute or otherwise use them for any public or commercial purpose.

For purposes of these terms, any use of these materials on any other web site or networked computer environment for any purpose is prohibited. The materials at this site are copyrighted and any unauthorised use of any materials at this site may violate copyright, trademark, and other laws. If you breach any of these terms, your authorization to use this site automatically terminates and you must immediately destroy any downloaded or printed materials.

12. Links to other web sites

Links to third party web sites on this site are provided solely as a convenience to you. If you use these links, you will leave this site. NWPA has not reviewed all of these third party sites and does not control and is not responsible for any of these sites or their content. NWPA does not endorse or make any representations about them, or any information, software or other products or materials found there on, or any results that may be obtained from using them. If you decide to access any of the third party sites linked to this site, you do this entirely at your own risk.

13. Exclusion of liability

Except where expressly provided in law, NWPA shall be under no liability whatsoever to registered users or any third party for any defect in, failure of, or unsuitability or inappropriateness for any purpose of this website or the services offered by NWPA through this website or third party equipment or software used to access the website or for infringement of rights or any other cause.  In any event NWPA’s maximum liability relating to the services provided by NWPA through this website, for any reason whatsoever, including without limitation for breach of contract, breach of statutory duty or negligence, shall be limited to £100.

Limitation of liability.
In no event will NWPA, its suppliers, or other third parties mentioned at this site be liable for any damages whatsoever (including, without limitation, those resulting from lost profits, lost data or business interruption) arising out of the use, inability to use, or the results of use of this site, any web sites linked to this site, or the materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.
If your use of the materials or information from this site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof. Applicable law may not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

The materials provided at this site are provided “as is” without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. NWPA further does not warrant the accuracy and completeness of the materials at this site.

15. Law

These terms and conditions and your use of the services offered through this website shall be governed by English law and the parties shall submit to the non-exclusive jurisdiction of the English Courts. If any provision of these terms and conditions is held invalid, the remaining provisions shall continue in full force and effect. The headings are for convenience only and shall have no effect on interpretation.
